General Terms and Conditions (GTC)

for the nydo online shop at www.nydo-studio.at

“nydo” is a brand of Designmöbel Direkt GmbH. The contractual partner for orders placed in the online shop at www.nydo-studio.at, as well as the provider of all services mentioned therein, is exclusively Designmöbel Direkt GmbH, based in Frankfurt am Main, Germany. Where these GTC refer to “nydo”, this legally refers to Designmöbel Direkt GmbH.

Below, you can find out the conditions under which you place orders with us, how a contract is formed, and which rights you as a consumer in Austria are entitled to.

1. General

• Our online shop is available to all customers aged 18 and over.
• We sell exclusively in standard household quantities.
• These GTC apply to all orders via www.nydo-studio.at. Separate B2B GTC apply to entrepreneurs.
• “Working days” are Monday to Friday, excluding public holidays in Austria.

2. Registration & Usage

• For an order, we require your personal data. This is processed in accordance with our Privacy Policy.
• Please keep your data up to date and handle your access credentials confidentially.
• Content that you post on our site (e.g., reviews) must not infringe upon the rights of third parties. nydo receives a non-exclusive, revocable right of use for publication on our channels.
• Only one customer account is permitted per customer.
• Misuse or unlawful use may lead to the suspension of the account.

3. Conclusion of Contract

• The contractual partner is Designmöbel Direkt GmbH.
• Contracts are concluded exclusively in German.
• The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order.
• By clicking on “Order with obligation to pay”, you submit a binding offer.
• You will receive an order confirmation via email immediately thereafter. This does not yet constitute acceptance of your offer. The contract is only concluded upon our shipping confirmation or delivery.
• The order data will be stored and sent to you by email. You will receive the contractual provisions together with the order confirmation on a durable medium (Section 7 of the FAGG).

4. Prices & Shipping Costs

• All prices are final prices and include the applicable statutory value-added tax (VAT).
• Shipping costs and any potential surcharges for additional services (e.g., assembly) are shown separately.
• The total price indicated at checkout is authoritative.

5. Assembly Service

• We offer an assembly service for selected products. Whether this is subject to a charge or included in the scope of delivery can be seen on the product page and at checkout.
• Assembly is carried out by nydo or by partners commissioned by us.
• Painting or electrical work is not part of the service.
• Risk transfers to you upon handover after assembly.
• If you expressly request that we begin the assembly service before the expiry of the statutory withdrawal period, the statutory provisions of the FAGG regarding the right of withdrawal for this service shall apply. The right of withdrawal regarding the delivered goods remains unaffected.
• Photos may be taken for documentation purposes.

6. Payment Methods

We offer: Advance payment (SEPA transfer), EPS transfer, credit card (Visa, Mastercard, American Express), PayPal, Apple Pay, Google Pay, and Klarna (invoice, instant transfer, installment purchase).

• Processing is handled via Shopify Payments or Mollie.
• For Klarna, the additional GTC and privacy provisions of Klarna apply. A credit check may be performed.

7. Invoices

We provide invoices electronically via email. The Austrian VAT of 20% is shown.

8. Vouchers

• Promotional vouchers (e.g., influencer codes) are not for sale, have a limited validity, and do not apply to shipping or assembly costs.
• Only one voucher can be redeemed per order.
• Remaining amounts will not be refunded in cash.
• Your statutory rights remain unaffected.

9. Delivery

• We deliver within Austria.
• Delivery time and shipping method (parcel or freight forwarder) depend on the information provided on the respective product page.
• nydo is not liable for delays caused by force majeure. If such an event lasts longer than 8 weeks, both parties may withdraw from the contract; any payments already made will be refunded immediately in this case.
• If delivery fails for reasons for which you are responsible, you will bear the costs for re-delivery and, if applicable, for intermediate storage.

10. Warranty & Liability

• The statutory warranty under Austrian law (Consumer Warranty Act – VGG and the General Civil Code – ABGB) applies. For new goods, the warranty period is two years from handover.
• For used goods, the warranty period can be reduced to one year, provided you were expressly informed of this before conclusion of the contract and this was agreed upon separately.
• nydo is liable without limitation for damages caused intentionally or by gross negligence.
• In the case of simple negligence, nydo is liable in accordance with statutory provisions. As far as legally permissible, liability for simple negligence regarding property damage is excluded, provided no essential contractual duty has been violated.
• Liability for personal injury and claims under the Product Liability Act (PHG) remain unaffected in any case. Also unaffected is liability for the malicious non-disclosure of a defect and the assumption of a guarantee.

11. Guarantees

Additional guarantees exist only if expressly stated on the product page. A guarantee exists alongside the statutory warranty and does not restrict it. Details can be found in our Guarantee Policy.

12. Right of Withdrawal

As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason (Sections 11 et seq. of the FAGG). All details, the calculation of the period, and the model withdrawal form can be found in our Withdrawal Instructions.

13. Consequences of Withdrawal

• In the event of withdrawal, we will refund all payments received from you, including the costs of our most cost-effective standard delivery. We may withhold the refund until we have received the goods back or you have provided proof that you have sent back the goods, whichever is earlier.
• You shall send the goods back to the return address provided in each case.
  nydo bears the costs of return within the scope of the statutory right of withdrawal.
• You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their condition, properties, and functionality. This may particularly be the case with damage, soiling, or improper use.

14. Voluntary Right of Return (100 Days)

a) Pillows – voluntary right of return: 14 days

• A voluntary right of return of 14 days from receipt of goods applies to pillows. The goods must be returned unused, in perfect hygienic condition, and in impeccable state.
• If the pillow was delivered sealed for health or hygiene reasons, a return is excluded if the seal or protective packaging has been removed after delivery.
• For a return that meets the conditions of this voluntary right of return, nydo bears the costs of return.

b) Armchairs and sofas – voluntary right of return: 100 days

• A total voluntary right of return of 100 days from receipt of goods applies to armchairs and sofas.
• The condition for this voluntary right of return is that the goods are returned complete and in a state corresponding to proper and careful use.
• The voluntary right of return is specifically excluded in cases of excessive use, improper handling, damage, heavy soiling, or other impairments that go beyond standard inspection and careful use.
• The original packaging is desired but not required.
• For a return that meets the conditions of this voluntary right of return, nydo bears the costs of return.
• The voluntary rights of return do not affect your statutory rights, in particular the statutory right of withdrawal under the FAGG and your statutory warranty rights.

We assume no responsibility for the content of external links. The operators of the linked content are exclusively responsible for their contents.

18. Copyright & Usage Rights

All content on www.nydo-studio.at is protected by copyright. Use beyond private use is only permitted with our written consent.

19. Dispute Resolution

We are not obligated or willing to participate in a dispute resolution procedure before a consumer arbitration board within the meaning of the Alternative Dispute Resolution Act (AStG).

20. Amendments to the GTC

The GTC published at the time of your order shall apply.

21. Final Provisions

• German law applies, excluding the UN Sales Convention. Mandatory consumer protection provisions of the state in which you have your habitual residence – for consumers in Austria, in particular the Consumer Protection Act (KSchG), the Distance and Off-Premises Transactions Act (FAGG), and the Consumer Warranty Act (VGG) – remain unaffected.
• For disputes arising from consumer contracts, the mandatory statutory provisions regarding place of jurisdiction apply.
• Should any provision of these GTC be invalid, the contract shall remain valid in all other respects.
