General Terms and Conditions (GTC)

"nydo" is a brand of Designmöbel Direkt GmbH. The contractual partner for orders placed in the online shop www.nydo-studio.ch, and the provider of all services listed therein, is exclusively Designmöbel Direkt GmbH (hereinafter "nydo"). These GTC govern the purchase of furniture and furnishing products by consumers residing in Switzerland. Nydo sells exclusively to consumers (B2C). Swiss law applies.
1. General
- Our online shop is available to customers aged 18 and over.
- We sell exclusively in quantities customary for private households.
- These GTC apply to all orders placed via www.nydo-studio.ch by consumers residing in Switzerland. Nydo's offering is directed exclusively at consumers (B2C); orders placed by companies for commercial purposes are not accepted.
- "Business days" means Monday to Friday, excluding public holidays at the delivery location in Switzerland.
- Goods are produced in Poland and delivered to Switzerland. Nydo assumes all customs formalities and import costs (DDP – Delivered Duty Paid, Incoterms 2020). Customers are not required to pay any additional customs duties or import charges.
2. Registration & Use
- To place an order, we require your personal data, which will be processed in accordance with our Privacy Policy.
- Please keep your data up to date and treat your login credentials confidentially.
- Content you post on our site (e.g. reviews) must not infringe third-party rights. Nydo receives a simple, revocable right of use for publication on our channels.
- Each customer may only hold one customer account.
- Misuse or unlawful use may result in the suspension of the account.
3. Formation of Contract
- The contractual partner is Designmöbel Direkt GmbH.
- Contracts are concluded exclusively in the German language.
- By clicking "Buy Now", you submit a binding offer in accordance with Art. 3 CO (Swiss Code of Obligations).
- You will immediately receive an acknowledgement of receipt by e-mail. This does not yet constitute acceptance. The contract is only concluded upon our dispatch confirmation or delivery (Art. 5 CO).
- Order data will be stored and sent to you by e-mail.
Special Rule for Certain Postal Codes (Logistics Surcharge)
For delivery addresses located in the postal code areas listed below, special logistical requirements apply (e.g. due to difficult accessibility or specialised transport routes) which may give rise to additional costs. Orders with a delivery address in one of these postal code areas are therefore not treated as binding purchase contracts, but initially as non-binding order requests ("draft").

After receipt of your order request, nydo or an authorised logistics partner will contact you to determine the individual logistics surcharge applicable to your delivery location and communicate it to you in writing. The binding purchase contract is only concluded once you have expressly agreed in writing (by e-mail) to the total price communicated, including the logistics surcharge, and nydo has confirmed this agreement.
Until express mutual agreement on the logistics surcharge has been reached, no binding contract exists. You are free to withdraw your order request at any time and at no cost.
4. Prices & Shipping Costs
- The prices displayed on the product page at the time of ordering, in Swiss Francs (CHF) inclusive of statutory value added tax (VAT, currently 8.1%), apply.
- Shipping costs and any additional charges for supplementary services (e.g. assembly) are shown separately.
- The price shown at checkout is decisive.
- Customs duties and import taxes are already included in the price for customers in Switzerland (DDP delivery).
5. Assembly Service
- For selected products, we offer a paid assembly service.
- Assembly is carried out by nydo or appointed partners.
- Painting or electrical work does not form part of the service.
- Risk passes to you upon handover following assembly.
- Photographs may be taken for documentation purposes (see Privacy Policy).
6. Payment Methods
We offer the following payment methods:
- Credit card (Visa, Mastercard, American Express)
- PayPal
- Apple Pay
- Google Pay
- TWINT
- Klarna (invoice, instant transfer, instalment purchase)
Payment processing is carried out via Shopify Payments or Mollie. For Klarna, Klarna's own terms and conditions and privacy policy also apply; a credit check may be carried out by Klarna.
7. Invoices
Invoices will be sent to you electronically by e-mail in accordance with the applicable provisions of the Swiss Federal Act on Value Added Tax (VAT Act).
8. Vouchers
- Promotional vouchers (e.g. influencer codes) are not available for purchase, have a limited validity period, and do not apply to shipping or assembly costs.
- Only one voucher may be redeemed per order.
- Remaining balances will not be refunded.
- Statutory rights remain unaffected.
9. Delivery
- Delivery within Switzerland only.
- Our logistics partner for Switzerland is Gyger. Delivery times and shipping method (parcel or freight carrier) are indicated on the product page.
- Nydo assumes all customs formalities and import duties; customers have no further import costs to bear (DDP delivery in accordance with Incoterms 2020).
- Nydo is not liable for delays due to force majeure events (e.g. natural disasters, pandemics, strikes, transport disruptions). If such an event lasts more than 8 weeks, either party is entitled to withdraw from the contract.
- If delivery fails due to reasons within your responsibility, you will bear the costs of a re-delivery attempt and any storage fees that may apply.
10. Warranty & Liability
- The statutory warranty for defects applies in accordance with the provisions of the Swiss Code of Obligations (CO), in particular Art. 197 et seq. CO.
- For second-hand goods, the warranty period may be contractually reduced to one year.
- Nydo is liable without limitation for intent and gross negligence.
- In cases of ordinary negligence, nydo is only liable for breach of essential contractual obligations, limited to the foreseeable and typical damage.
- Claims under the Swiss Federal Product Liability Act (PLA), as well as claims for injury to life, body or health, for fraudulent misrepresentation, or under an expressly assumed guarantee, remain unaffected.
11. Commercial Guarantees
Additional guarantees exist only if expressly stated on the product page. Details can be found in our Guarantee Policy.
12. Right of Return
Swiss law (CO) does not provide for a statutory right of withdrawal for online purchases. However, nydo grants the following voluntary rights of return, which vary by product category:
a) Pillows – voluntary right of return: 14 days
For pillows, a voluntary right of return of 14 days from receipt of the goods applies. The goods must be returned unused and in a hygienically impeccable condition. For hygiene reasons, returns are excluded if the protective packaging has been removed after delivery. Return shipping costs are borne by nydo provided the stated conditions are met.
b) Armchairs and sofas – voluntary right of return: 100 days
For armchairs and sofas, an extended voluntary right of return of 100 days from receipt of the goods applies. The goods must be returned complete and in perfect condition. Original packaging is preferred but not mandatory. Return shipping costs are borne by nydo provided all stated conditions are met.
To exercise your right of return, please contact service@nydo-studio.ch. The voluntary rights of return do not affect statutory warranty rights under the CO.
13. Retention of Title
Goods remain the property of nydo until payment has been made in full (simple retention of title in accordance with Art. 715 SCC).

16. Data Protection
Our Privacy Policy applies and is available at www.nydo-studio.ch/privacy. For the processing of personal data of individuals residing in Switzerland, the revised Swiss Federal Act on Data Protection (FADP, in force since 1 September 2023) applies. Nydo implements the necessary technical and organisational measures to protect customers' personal data.
17. Copyright & Rights of Use
All content on www.nydo-studio.ch is protected by copyright. Use beyond private purposes is only permitted with nydo's prior written consent.
18. Dispute Resolution
Nydo does not participate in dispute resolution proceedings before consumer arbitration boards. In the event of a dispute, legal recourse is available in accordance with the Swiss Civil Procedure Code (CPC). The place of jurisdiction is, to the extent permitted by law, Frankfurt am Main, Germany; mandatory Swiss jurisdiction provisions in favour of the customer are reserved (in particular Art. 32 CPC).
19. Amendments to the GTC
The GTC in force at the time of the order apply.
20. Final Provisions
- Swiss law applies (CO, SCC, PLA, FADP, etc.), to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
- Should any provision of these GTC be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid rule that most closely reflects the economic purpose of the original provision.
- These GTC apply exclusively to orders placed from Switzerland via www.nydo-studio.ch.
